A PROCLAMATION BY THE GOVERNOR TO THE MEMBERS OF THE LEGISLATURE:

WHEREAS, by the provisions of Section 121 of the Constitution of the State of Mississippi, the Governor is vested with the power to convene by public Proclamation the Legislature in Extraordinary Session whenever, in his judgment, the public interest requires it; and

WHEREAS, it is my judgment that the public interest requires that the Legislature be convened in the Third Extraordinary Session of 2004 for the consideration of the matter hereinafter stated:

NOW, THEREFORE, I, Haley Barbour, Governor of the State of Mississippi, do hereby issue this Proclamation to convene the Legislature in Extraordinary Session, and do designate Monday, November 8, 2004, at 1:00 P.M., as the time, and the State Capitol in the City of Jackson, Mississippi, as the place, in which said Session shall be convened; and do designate as the subject to be considered at said Extraordinary Session, when so convened, the following matters so relating exclusively to the issuance of state general obligation bonds for economic development and for no other purpose:

1. AN ACT TO AUTHORIZE THE ISSUANCE OF STATE GENERAL OBLIGATION BONDS TO PROVIDE FUNDS FOR CONSTRUCTION AND OTHER IMPROVEMENTS AT THE STATE-OWNED SHIPYARD LOCATED IN JACKSON COUNTY, MISSISSIPPI; TO PROVIDE THAT THE ISSUANCE OF SUCH BONDS SHALL BE CONDITIONED ON THE LESSEE INCURRING A CERTAIN AMOUNT OF DEBT FOR IMPROVEMENTS, INVESTMENTS OR UPGRADES TO SHIPYARDS IN MISSISSIPPI OWNED OR LEASED BY SUCH LESSEE;

2. AN ACT TO AMEND SECTION 57-75-5(f)(xii), MISSISSIPPI CODE OF 1972, TO REVISE THE DEFINITION OF THE TERM "PROJECT" FOR PURPOSES OF THE MISSISSIPPI MAJOR ECONOMIC IMPACT ACT TO INCLUDE ANY PROJECT BUILT ACCORDING TO THE SPECIFICATIONS AND FEDERAL PROVISIONS SET FORTH BY THE NATIONAL AERONAUTICS AND SPACE ADMINISTRATION (NASA) AT STENNIS SPACE CENTER FOR THE PURPOSE OF CONSOLIDATING COMMON SERVICES FROM NASA CENTERS IN HUMAN RESOURCES, PROCUREMENT, FINANCIAL MANAGEMENT AND INFORMATION TECHNOLOGY TO BE LOCATED ON LAND OWNED OR CONTROLLED BY NASA, UPON FINAL AWARD BY NASA OF A CONTRACT TO PERFORM THESE CONSOLIDATED SERVICES AT THE STENNIS SPACE CENTER LOCATION; TO AMEND SECTION 57-75-15, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE ISSUANCE OF STATE GENERAL OBLIGATION BONDS FOR CERTAIN PROJECTS UNDER THE MISSISSIPPI MAJOR ECONOMIC IMPACT ACT;

3. AN ACT TO AMEND SECTION 57-75-5, MISSISSIPPI CODE OF 1972, TO REVISE THE DEFINITION OF THE TERM "PROJECT" UNDER THE MISSISSIPPI MAJOR ECONOMIC IMPACT ACT TO FURTHER ADDRESS INFRASTRUCTURE AND OTHER NEEDS AT MILITARY BASES IN MISSISSIPPI UPON DESIGNATION BY THE MISSISSIPPI MAJOR ECONOMIC IMPACT AUTHORITY THAT ANY SUCH BASE WAS OR IS AT RISK TO BE RECOMMENDED FOR CLOSURE OR REALIGNMENT PURSUANT TO THE DEFENSE BASE CLOSURE AND REALIGNMENT ACT OF 1990; TO AMEND SECTION 57-75-15, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE ISSUANCE OF STATE GENERAL OBLIGATION BONDS FOR SUCH PURPOSES;

4. AN ACT TO AMEND SECTION 57-75-5, MISSISSIPPI CODE OF 1972, TO REVISE THE DEFINITION OF THE TERM "PROJECT" FOR PURPOSES OF THE MISSISSIPPI MAJOR ECONOMIC IMPACT ACT TO INCLUDE PHARMA PAC, A PHARMACEUTICAL MANUFACTURING, PACKAGING AND DISTRIBUTION FACILITY, WITH AN INITIAL CAPITAL INVESTMENT FROM ANY LOCAL OR FEDERAL SOURCES OF NOT LESS THAN ONE MILLION NINE HUNDRED THOUSAND DOLLARS ($1,900,000.00) WHICH WILL CREATE AT LEAST NINETY (90) FULL-TIME JOBS; TO AMEND SECTION 57-75-15, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE ISSUANCE OF STATE GENERAL OBLIGATION BONDS FOR CERTAIN PROJECTS UNDER THE MISSISSIPPI MAJOR ECONOMIC IMPACT ACT;

5. AN ACT TO AMEND SECTION 57-75-5, MISSISSIPPI CODE OF 1972, TO REVISE THE DEFINITION OF THE TERM "PROJECT" FOR PURPOSES OF THE MISSISSIPPI MAJOR ECONOMIC IMPACT ACT TO INCLUDE TIM TEK, A MAJOR INDUSTRIAL WOOD PROCESSING FACILITY, WITH AN INITIAL CAPITAL INVESTMENT OF NOT LESS THAN ONE HUNDRED MILLION AND NO/100 DOLLARS ($100,000,000.00), WHICH WILL CREATE AT LEAST ONE HUNDRED TWENTY-FIVE (125) FULL TIME JOBS WHICH PROVIDE AN AVERAGE ANNUAL SALARY, EXCLUDING BENEFITS, WHICH ARE NOT SUBJECT TO MISSISSIPPI INCOME TAXES, OF AT LEAST THIRTY THOUSAND AND NO/100 DOLLARS ($30,000); TO AMEND SECTION 57-75-15, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE ISSUANCE OF STATE GENERAL OBLIGATION BONDS FOR CERTAIN PROJECTS UNDER THE MISSISSIPPI MAJOR ECONOMIC IMPACT ACT;

6. AN ACT TO AMEND SECTION 57-75-5, MISSISSIPPI CODE OF 1972, TO REVISE THE DEFINITION OF THE TERM "PROJECT" FOR PURPOSES OF THE MISSISSIPPI MAJOR ECONOMIC IMPACT ACT TO INCLUDE BAXTER HEALTHCARE, A MAJOR PHARMACEUTICAL FACILITY, WITH A CAPITAL INVESTMENT OF NOT LESS THAN FORTY MILLION DOLLARS ($40,000,000.00) OVER A PERIOD OF FIVE (5) CONSECUTIVE YEARS FROM THE INITIAL DATE OF ANY LOAN OR GRANT MADE BY THE MISSISSIPPI DEVELOPMENT AUTHORITY FOR SUCH PROJECT, WHICH WILL MAINTAIN AT LEAST SEVEN HUNDRED FIFTY (750) FULL-TIME EMPLOYEES; TO AMEND SECTION 57-75-15, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE ISSUANCE OF STATE GENERAL OBLIGATION BONDS FOR CERTAIN PROJECTS UNDER THE MISSISSIPPI MAJOR ECONOMIC IMPACT ACT;

7. AN ACT TO AUTHORIZE THE ISSUANCE OF STATE GENERAL OBLIGATION BONDS TO AID IN THE CONSTRUCTION, FURNISHING, EQUIPPING AND OPERATING OF THE UNIVERSITY MEDICAL CENTER CANCER INSTITUTE, AS DETERMINED BY THE VICE CHANCELLOR FOR HEALTH AFFAIRS FOR THE UNIVERSITY MEDICAL CENTER TO BE IN THE BEST INTEREST OF THE UNIVERSITY MEDICAL CENTER, AND APPROVED BY THE BOARD OF TRUSTEES OF STATE INSTITUTIONS OF HIGHER LEARNING, AND TO AID IN THE PURCHASE OF EQUIPMENT;

8. AN ACT TO AMEND SECTION 57-75-5, MISSISSIPPI CODE OF 1972, TO REVISE THE DEFINITION OF THE TERM "PROJECT" FOR PURPOSES OF THE MISSISSIPPI MAJOR ECONOMIC IMPACT ACT TO INCLUDE VIKING RANGE CORPORATION, A MAJOR CAPITAL PROJECT WITH A RESEARCH AND DEVELOPMENT COMPONENT LOCATED ON ONE OR MORE SITES WITH AN INITIAL CAPITAL INVESTMENT FROM ANY SOURCE OR COMBINATION OF SOURCES OF NOT LESS THAN TEN MILLION DOLLARS ($10,000,000.00) WHICH WILL CREATE AT LEAST TWO HUNDRED FIFTY (250) FULL TIME JOBS; TO AMEND SECTION 57-75-15, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE ISSUANCE OF STATE GENERAL OBLIGATION BONDS FOR CERTAIN PROJECTS UNDER THE MISSISSIPPI MAJOR ECONOMIC IMPACT ACT;

9. AN ACT TO AUTHORIZE THE ISSUANCE OF STATE GENERAL OBLIGATION BONDS TO PROVIDE FUNDS FOR THE SMALL MUNICIPALITIES AND LIMITED POPULATION COUNTIES FUND; TO AMEND SECTION 57-1-18, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT A PORTION OF THE PROCEEDS OF CERTAIN BONDS MAY BE UTILIZED BY THE MISSISSIPPI DEVELOPMENT AUTHORITY TO REIMBURSE CERTAIN COSTS RELATED TO THE ADMINISTRATION OF THE FUND AND TO LIMIT THE AMOUNT OF GRANTS ISSUED TO A MUNICIPALITY OR COUNTY DURING ANY GRANT PERIOD TO $250,000.00;

10. AN ACT TO AMEND SECTION 57-61-25, MISSISSIPPI CODE OF 1972, TO INCREASE FROM $290,000,000.00 TO $292,000,000.00 THE AMOUNT OF GENERAL OBLIGATION BONDS THAT MAY BE ISSUED UNDER THE MISSISSIPPI BUSINESS INVESTMENT ACT; TO AMEND SECTION 57-61-36, MISSISSIPPI CODE OF 1972, TO INCREASE FROM $8,500,000.00 TO $10,500,000.00 THE AMOUNT OF BOND PROCEEDS THAT THE MISSISSIPPI DEVELOPMENT AUTHORITY MAY UTILIZE UNDER THE MISSISSIPPI BUSINESS INVESTMENT ACT TO MAKE GRANTS OR LOANS TO COUNTIES AND MUNICIPALITIES THROUGH AN EQUIPMENT AND PUBLIC FACILITIES GRANT AND LOAN FUND TO AID IN INFRASTRUCTURE-RELATED IMPROVEMENTS, THE PURCHASE OF EQUIPMENT AND IN THE PURCHASE, CONSTRUCTION OR REPAIR AND RENOVATION OF PUBLIC FACILITIES;

11. AN ACT TO AMEND SECTION 69-2-13, MISSISSIPPI CODE OF 1972, TO REMOVE THE JUNE 30, 2004, REPEAL DATE ON THE PROGRAM THAT AUTHORIZES THE MISSISSIPPI DEVELOPMENT AUTHORITY TO LOAN OR GRANT FUNDS FROM THE EMERGING CROPS FUND TO ASSIST IN PROVIDING FINANCING FOR MINORITY ECONOMIC DEVELOPMENT AND TO INCREASE THE AMOUNT THAT MAY BE DRAWN FOR SUCH PURPOSE FROM $25,000,000.00 TO $26,000,000.00; TO AMEND SECTION 69-2-19, MISSISSIPPI CODE OF 1972, TO INCREASE THE AGGREGATE AMOUNT OF STATE GENERAL OBLIGATION BONDS THAT MAY BE ISSUED FOR THE EMERGING CROPS FUND FROM $104,000,000.00 TO $105,000,000.00;

12. AN ACT TO AMEND SECTION 57-85-5, MISSISSIPPI CODE OF 1972, TO AUTHORIZE THE ISSUANCE OF STATE GENERAL OBLIGATION BONDS TO PROVIDE FUNDS FOR THE MISSISSIPPI RURAL IMPACT FUND;

13. AN ACT TO AUTHORIZE THE ISSUANCE OF GENERAL OBLIGATION BONDS OF THE STATE OF MISSISSIPPI FOR THE PURPOSE OF PROVIDING FUNDS FOR THE MISSISSIPPI LAND, WATER AND TIMBER RESOURCES FUND; TO AMEND SECTION 69-46-7, MISSISSIPPI CODE OF 1972, TO REQUIRE THAT A CERTAIN AMOUNT OF THE MONEY IN THE LAND, WATER AND TIMBER FUND SHALL BE UTILIZED TO ENCOURAGE, PROMOTE AND INITIATE THE DEVELOPMENT OF ALTERNATIVE ENERGY STRATEGIES, APPLIED RESEARCH TECHNOLOGIES AND COMMERCIALIZATION ENTERPRISES THAT FOCUS ON MISSISSIPPI NATURAL RESOURCES; TO AUTHORIZE A CERTAIN AMOUNT OF MONEY IN THE FUND TO BE UTILIZED BY THE MISSISSIPPI DEVELOPMENT AUTHORITY, THE DEPARTMENT OF AGRICULTURE AND COMMERCE AND THE DEPARTMENT OF AUDIT TO DEFRAY COSTS INCURRED IN ASSISTING IN THE ADMINISTRATION OF THE MISSISSIPPI LAND, WATER AND TIMBER RESOURCES ACT;

14. AN ACT TO AUTHORIZE THE ISSUANCE OF GENERAL OBLIGATION BONDS OF THE STATE OF MISSISSIPPI FOR THE PURPOSE OF RENOVATION AND UPGRADES OF SYSTEMS AT THE LOCKHEED MARTIN LABORATORY AT THE STENNIS SPACE CENTER TO MAKE THE FACILITY FUNCTIONAL FOR ITS INTENDED PURPOSE AND FOR REIMBURSEMENTS TO THE USER OF THE FACILITY FOR UPGRADES TO THE FACILITY THAT WERE PAID FOR BY THE USER.

Such other matters as may be submitted by the Governor for consideration during such Extraordinary Session.
