WHEREAS, the entire State of Mississippi was severely affected by Hurricane Katrina, beginning on August 27, 2005, with hurricane and tropical storm force winds, severe thunderstorms, tornadoes and flooding; and
WHEREAS, Hurricane Katrina caused personal injuries, complete devastation to homes, businesses, and public property, and threatened the safety of the citizens and property throughout the entire State of Mississippi; and
WHEREAS, persons living in damaged areas of our state may not be able to make regularly scheduled payments on mortgage obligations and risk losing their homes and businesses to foreclosures; and
WHEREAS, Sections 89-1-301 through 89-1-329 of the Mississippi Code of 1972, as Amended, provide certain relief from “inequitable mortgage foreclosures” in the event of a disaster in which the Governor has specifically included these provisions as available for relief to Mississippians.
NOW, THEREFORE, I, Haley Barbour, Governor of the State of Mississippi, pursuant to the authority vested in me under the Constitution of the State of Mississippi and Section 33-15-11(b) (17), Mississippi Code of 1972, as amended, and in the public interest and for the general welfare, do hereby proclaim that Hurricane Katrina is a disaster in which Sections 89-1-301 though 89-1-329 of the Mississippi Code are available for relief. The counties which are covered by this Proclamation include all counties in the State of Mississippi.
FURTHER, all agencies of the State of Mississippi shall discharge their emergency responsibilities as deemed necessary as set forth in the State of Mississippi Emergency Operations Plan and Executive Order No. 653, dated November 16, 1990.
